At a glance

  • Sign and upload Form e-PG3D-9 accepting the DP's anticorruption guidelines.
  • You must not be under sanction by any development partner in Bangladesh.
  • Missing forms, priced schedule or tender security means instant rejection.
  • A very low price triggers a written request for a detailed price analysis.
  • Percentages and deadlines are set in the TDS and PCC for each package; read them.

For suppliers, traders and manufacturers with an active e-GP registration bidding on goods for World Bank, ADB, JICA and other development partner financed projects.

A DP sanction can outlast the tender. Corrupt, fraudulent, collusive, coercive or obstructive practice on a DP-financed contract can lead the development partner to declare you ineligible for its contracts, indefinitely or for a period, on top of any action under Bangladesh law. Read the DP guidelines in Section 7 before you sign Form e-PG3D-9.

01Is This Tender for You?

e-PG3D is BPPA's Standard e-Tender Document for national goods tenders of any value under the Open Tendering Method, on projects financed by a development partner. You will see "e-PG3D" as the STD in the e-GP notice, and the development partner is named in the TDS.

The process feels like any e-GP goods tender, with three extra points: the DP's anticorruption letter, the DP sanctions check, and a price-analysis review instead of the SLT formula if your price looks too low.

02Eligibility and DP Sanctions

  • Open to tenderers from all countries except any the TDS excludes; you need legal capacity to sign and enrolment in the relevant professional or trade organisation in your country.
  • No DP sanction: you must not be under sanction by any development partner operating in Bangladesh on procurement-related grounds.
  • Taxes and social security contributions paid as required by law.
  • Not suspended or debarred for corrupt, fraudulent, collusive, coercive or obstructive practices, or for fundamental breach of contract.
  • Not insolvent, in receivership, bankrupt or being wound up, and not barred from business.
  • No link to a consultant who prepared the design or specifications, and no conflict of interest with another tenderer (common control, subsidy, same legal representative, or influence over another tender).
  • Government-owned enterprises may tender only if legally and financially autonomous, operating under commercial law, and not dependent on the PE.
  • These rules also apply to subcontractors. If awarded, you disclose beneficial ownership in Form e-PG3D-2 by the date in the NOA and consent to its publication.
  • You must let the Government, BPPA and the DP inspect and audit your accounts and records on the tender and contract.

One tender only. Submitting more than one tender for the same item or lot gets all tenders with your participation rejected. Alternative tenders are not allowed in e-GP.

03Qualification Criteria

These are pass/fail. e-PG3D leaves the figures to the TDS of each package, so check them before you buy the document.

CriterionWhat the TDS setsEvidence
General experienceMinimum years supplying the goods, counted back from IFT publicationYear of registration, constitution or licensing
Specific experienceNumber of similar contracts in the last N years, each of a minimum value, public or private sectorCompletion certificates issued or certified by the PE
Supply / production capacityAt least the proposed supply requirement in any one year within the last N yearsRelevant documents or updated supplier or manufacturer brochures
Liquid assetsA minimum amount, net of other contractual commitmentsUnconditional bank credit line, or working capital in the last year's audit report
Financial standingAudited profit and loss and balance sheets for the years in the TDSAudit reports
LitigationPending litigation must not seriously affect your finances; all pending cases are treated as lostStatement on your letterhead

For several lots, your resources must meet the combined criteria of the lots you want to win.

04Subcontracting

  • You may subcontract an activity or part of the goods worth up to 30% of the whole goods value.
  • Identify each subcontracted item and subcontractor in Form e-PG3D-3, completed and signed by the subcontractor. The PE may ask for more detail or a substitute.
  • A subcontractor may join more than one tender, but only as a subcontractor.
  • You stay fully responsible. Bringing in a subcontractor after signing is a ground for termination for default.

05Questions and Addenda

  • Post clarification requests through the e-GP dashboard before the date in the TDS. The PE answers within 5 working days and need not answer late requests.
  • A pre-tender meeting, if any, is online in e-GP. You can post questions until the meeting ends; questions by fax, post or e-mail are not accepted. Attendees' names are not shared, and missing the meeting does not disqualify you.
  • Only a numbered, dated Addendum can change the document. If one arrives with less than one-third of the preparation time left, the deadline is extended by at least 3 working days.

06Documents to Upload

DocumentWhat to check

OtherAny extra documents in the TDS; autonomy proof for government-owned enterprises.

Tenders are written in English. Supporting documents in other languages need an accurate English or Bangla translation of the relevant parts, at your cost.

07Tender Security

  • Ask an e-GP registered bank to prepare the e-tender security for the TDS amount in favour of the PE.
  • Form: bank draft, pay order, or an irrevocable unconditional bank guarantee in Form e-PG3D-7 from a scheduled bank, without alteration.
  • It must stay valid at least 28 days beyond tender validity. A tender without a valid security is non-responsive.
  • Return: non-responsive tenderers after the evaluation report is approved; the three lowest responsive tenderers once the winner furnishes performance security and signs.

Your security can be forfeited if you:

  • Fail to furnish the performance security, or furnish one that is not authentic.
  • Refuse or fail to sign the contract.
  • Engage in corrupt, fraudulent, collusive, coercive or obstructive practice.

08Price Your Tender

  • Quote unit rates for every item in figures and words, excluding discounts, in Taka.
  • Each item must be priced for its full quantity, and a lot tender must cover 100% of its items and quantities. Leaving out an item worth more than 50% of the lot value makes the tender non-responsive.
  • Include all taxes, customs duties, VAT and levies as of 28 days before the deadline, plus profit, overheads and banking and insurance charges, as the delivered price at the point of delivery.
  • Prices are fixed. If a tax rate changes by law after signing, the price is adjusted (with HOPE's approval) so your net amount is unaffected.
  • Offer any unconditional discount, and how to apply it, in the Discount Form; it applies equally to all items in the lot.
  • e-GP does not correct arithmetic errors, so check every figure before you submit.
  • Keep item prices balanced. If the TEC finds them unbalanced, it can raise your performance security up to 25% of the contract price.

If your price is much lower than others The TEC may treat it as potentially abnormally low and ask you, in writing, for a detailed price analysis covering scope, methodology, schedule, risks and responsibilities. Keep your costing worksheets ready. If you cannot show you can deliver at that price, your tender is rejected.

09Technical Compliance

  • Declare the country of origin of every item in the price schedules, with supporting evidence. Origin is where goods were produced or substantially transformed, not your nationality.
  • Prove conformity with literature, drawings and data: a detailed description of the essential technical and performance characteristics, and an item-by-item commentary on the PE's specifications.
  • Goods must be new, unused, of the latest models, and meet the stated standards (or, if none, the latest standards of the country of origin).
  • Minor deviations that do not meaningfully change specifications or commercial terms may be accepted; anything material will not.

10Submit Through e-GP

  1. Pay the document fee through an e-GP member bank by the day before the deadline, then download the e-TD. There are no other preconditions to buy it.
  2. Check every file is virus-free, readable and complete. Corrupt or unreadable files are not considered.
  3. Allow time for large uploads; late submission is impossible in e-GP.
  4. Final-submit. Your e-signature authenticates the tender, it is stored encrypted, and you receive a confirmation e-mail.
  5. You can modify, substitute or withdraw only before the deadline. After opening, e-GP shares the Tender Opening Report with you.

The tender must remain valid for the TDS period. The PE may ask, at most twice, to extend validity; you may refuse without losing your security, but your tender then drops out. If you agree, extend your security by 28 days beyond the new date and do not change your tender.

11How You Are Evaluated

  1. Preliminary: all forms signed (including e-PG3D-9), priced schedule and a valid tender security. Anything missing means rejection.
  2. Technical: origin, conformity (Form e-PG3D-5) and each qualification criterion, judged only on your tender.
  3. Financial: economic factors and discounts, then an abnormally low tender review where needed.
  4. Post-qualification: your documents are verified, possibly with a visit to your premises. If you fail, the next lowest is considered.
  • The TEC may ask for clarifications, including breakdowns of unit rates (through e-GP, from the Chairperson), with at least 3 working days to reply. You cannot use a reply to change your tender.
  • From opening until the NOA, do not contact the PE except to answer a clarification or file a complaint. Trying to influence evaluation can make your tender non-responsive and lead to action under Section 64(5) of the PPA.
  • There are no negotiations. Ties are settled by checking for collusion, then past performance with the PE, then quality; never by lottery.

12Award and Contract Signing

  1. The NOA (Form e-PG3D-10) arrives within 3 working days of approval. It states the price, performance security amount and format, and the dates for the security, your beneficial ownership information and signing. With it, you are bound.
  2. Quantities may change by up to 20% at award, at your quoted unit prices.
  3. Furnish the performance security (TDS percentage; bank draft, pay order or bank guarantee in Form e-PG3D-12 from a scheduled bank, valid 28 days beyond the intended completion date) and sign the Contract Agreement (Form e-PG3D-11) on time. Government enterprises have a security deposit deducted from invoices instead.
  4. Failing to furnish security or sign forfeits your tender security, and the award goes to the next tenderer.
  5. Start supplying only after these steps. Your signed Form e-PG3D-9 and the DP documents become part of the contract, and the PE publishes your beneficial ownership details for contracts above Tk. 10 lakh.

If you lose, you may ask for a debriefing on your own tender's weaknesses, and you may complain and appeal under Sections 29 and 30 of the PPA 2006 and Rules 72 to 77 of PPR 2025.

13Payment, Delivery and Warranty

  • Payment follows the PCC: any advance percentage (against an advance payment guarantee in Form e-PG3D-13), then the delivery and acceptance percentage, due against the PE's Acceptance Certificate.
  • Pack goods to survive transit, with a packing list and the PCC markings; insure them until accepted; deliver to the site in the price schedule.
  • Carry out the PCC tests at your cost and report results. Rejected goods are rectified or replaced at your cost.
  • The TEAC starts inspection within 24 hours of delivery; the Acceptance Certificate follows within 14 working days (partial if defects are found).
  • Invoice with the PCC documents. The PE pays within the PCC days and owes the PCC late-payment rate if it is late.
  • Your performance security is returned within 7 days of final payment and the Acceptance Certificate, if there is no claim. Retention is held until the warranty ends and released if goods are free of patent and latent defects.
  • Warranty is at least 3 months for supplies and 1 year for equipment (or the PCC period), starting when the delivery chalan is accepted. Repair or replace defective goods within the PCC days.
  • You bear permits, licences, taxes and duties, and you indemnify the PE against intellectual-property claims.

14Delays, Penalties and Disputes

  • Need more time? Notify the PE in writing with the cause and duration before the original delivery date. The PE decides within 21 days; justified extensions carry no liquidated damages.
  • Liquidated damages: the PCC percentage per day of the value delivered late, up to the PCC maximum, deducted from your payments.
  • Force majeure: notify within 14 days; HOPE decides whether it applies. It excuses delay but not payment obligations.
  • Performance security claims: the PE may claim if a notified breach or unpaid amount continues for 14 days or more.

Liquidated damages example Goods worth Tk. 10 lakh are delivered 8 days late and the PCC rate is 0.10% per day: 10,00,000 × 0.001 × 8 = Tk. 8,000 deducted from your payment (subject to the PCC maximum).

The PE may terminate for default, after a Notice of Default giving you 21 days to explain, if you:

  • Fail to deliver within the contract period or extension.
  • Do not maintain a required security, or fail any other obligation.
  • Engage in corrupt, fraudulent, collusive, coercive or obstructive practice.
  • Reach the maximum liquidated damages, or bring in a subcontractor after signing.

After termination you may be charged the PE's extra cost at the PCC percentage of the undelivered supply. The PE may also terminate for your insolvency, or for its convenience on 21 days' notice. Disputes go to amicable settlement, then the Adjudicator (you pay the fees, the PE reimburses half), then arbitration under the Arbitration Act 2001.

16Common Questions

What is Form e-PG3D-9 and do I really need it?

It is your signed acceptance of the development partner's anticorruption guidelines (for a World Bank project, the ACG letter). The TDS requires it as part of your tender, and it becomes part of the contract. Leaving it out can get your tender rejected at the preliminary stage.

Is there an SLT lower price limit like in e-PG3?

No. If your price looks abnormally low, the TEC asks you in writing for a detailed price analysis. The tender is rejected only if you cannot show you can perform at that price.

Am I rejected for quoting above the official estimate?

There is no automatic 10% ceiling in e-PG3D. The PE may reject all tenders if the lowest price exceeds a realistic estimate and does not match the market price.

How do I know if I am under a DP sanction?

Development partners publish lists of sanctioned or debarred firms and individuals. Check the list of the DP named in the TDS, including for your subcontractors, before tendering.

Who pays me: the PE or the development partner?

The PE manages the contract and payments. Where the DP pays from the financing, it does so only on the Government's request and with its approval under the financing agreement.
