e-PG8 National Two-Envelope Goods Participation Guideline

How your firm tenders for specialised goods under e-PG8: who can take part, what goes in the technical and the financial offer, how to price so you are neither above the ceiling nor rejected as too low, how you are evaluated, and how delivery, acceptance, warranty and payment work.

At a glance

  • Your price is opened only if your technical offer passes.
  • Sole tenderers only; no JV; subcontract up to 30%.
  • More than 10% above the official estimate: rejected.
  • Far below the others: rejected as significantly low-priced.
  • 10% retention held until the warranty ends.

For importers, local agents of manufacturers, distributors and Bangladeshi manufacturers of specialised equipment.

This is a working summary, not the official document. The tender document for your package (TDS, PCC, Schedule of Requirements, specifications), the Public Procurement Act 2006 and PPR 2025 take priority. PG8 is a preliminary BPPA draft describing paper envelopes; if the tender is on e-GP, follow the system's two-part submission. Raise inconsistencies through clarification before the deadline. Figures are illustrative.

01Is This Tender for You?

e-PG8 is used for goods with high-end specifications, such as medical, laboratory, IT or industrial equipment. Your technical offer is judged on its own first; only if it complies is your price opened and compared.

Method
One Stage Two Envelope, national
Value
Any
Currency
BDT, fixed price
Tender security
Fixed amount, up to 3% of estimate
Performance security
10% of contract price
Retention
10%, until warranty ends

Ordinary goods are usually tendered under e-PG3; turnkey plant with installation and guarantees under e-PG5A (National).

02Eligibility and Subcontracting

  • Firms from any country except those in TDS 5.1; goods not from countries in TDS 6.1. Origin is where the goods are made, not your nationality.
  • Legal capacity, trade-body membership, taxes paid; not insolvent, debarred, suspended or restricted by a development partner.
  • No conflict of interest: no common control, subsidy or shared representative with another tenderer, and no link to whoever prepared the specifications.
  • A government enterprise must show legal and financial autonomy.
  • Beneficial ownership declared and published if you win.

Subcontracting: name each subcontractor and item on Form PG8-3, within the TDS percentage (never above 30% of value). Subcontractors must meet the same eligibility rules.

  • form a joint venture: not allowed;
  • submit more than one tender per lot: all are rejected;
  • add subcontractors after signing: a fundamental breach.

03Qualification Evidence

CriterionEvidence
General experienceYear of registration or licensing
Specific experienceCompletion certificates for similar supplies within the look-back period (often 60–80% of the estimate)
Supply or production capacityDocuments or current brochures from you or the manufacturer (often twice the quantity required)
LitigationStatement on letterhead; pending cases treated as lost
Liquid assetsBank statement with 3 months' transactions, approved credit line, credit commitment letter (PG8-8) not older than 28 days, or audited working capital; often 80–100% of the estimate
Manufacturer's authorisationForm PG8-6 on the manufacturer's letterhead, if the TDS requires and you are not the maker
After-sales serviceIf required, a capable agent in Bangladesh

Example For 10 ultrasound systems estimated at Tk. 8 crore, expect to show a similar contract of about Tk. 4.8–6.4 crore, capacity to supply 20 units a year, and Tk. 6.4–8 crore in liquid assets or a bank credit commitment. Arrange the bank letter early: it must be dated within 28 days of the deadline.

04Questions, Meetings and Addenda

  • Buy the document from the PE or its listed agent, up to the day before the deadline.
  • Ask in writing before the TDS cut-off; answers come within 5 working days and go to all buyers.
  • Attend the pre-tender meeting if held; send questions a day ahead. Missing it does not disqualify you.
  • Acknowledge each addendum; if you miss one, tell the PE before two-thirds of the tender period passes.
  • If the specification points to one brand, ask now; after opening you cannot change your offer.

05Envelope 1: Technical Offer

Letters and authorityTechnical submission letter (PG8-1a); letter of authorization (PG8-1A) with the signatory's NID
InformationTenderer information (PG8-2); subcontractor information (PG8-3)
Tender securityOriginal, see section 07
Legal and taxTrade licence, TIN, return acknowledgement for the TDS assessment year, VAT/BIN, affidavits on legal capacity and solvency, trade-body membership
GoodsCountry of origin, specification compliance sheet (PG8-5) with make, model and full specification, brochures and data, spare parts list if required
Technical proposalSupply plan, risks and mitigation, delivery schedule
AlternativesOnly if the TDS allows, marked "Alternative"

Do not put any price in Envelope 1. Answer every specification line with your actual figure, not "complied".

06Envelope 2: Financial Offer

  • Financial submission letter (PG8-1b) with total price, advance requested, mandatory spare parts price if required, and unconditional discounts.
  • Price Schedule PG8-4A-1 for goods and PG8-4A-2 for related services, unit rates in figures and words, for the full quantity of every item.
  • Delivered prices in BDT, including VAT, taxes, duties, transport, insurance and profit. Prices are fixed.
  • Lot-by-lot: quote at least 80% of the items covering 65% of the lot value, or the lot is non-responsive.
  • Initial any correction you make before submission.

Example: pricing within the limits With an official estimate of Tk. 8 crore, any price above Tk. 8.80 crore is rejected outright. At the low end, the limit depends on the other prices: in a field of 7.90, 7.40 and 6.20 crore, the cut-off works out to about Tk. 6.69 crore, so the 6.20 tender is rejected even though it is cheapest.

07Security, Sealing and Submission

  • Tender security for the exact TDS amount, by pay order, bank draft or scheduled bank guarantee (PG8-7), in Envelope 1, valid 28 days beyond tender validity.
  • Prepare original and copies of each offer, numbered and signed on every page.
  • Seal technical original and copies into "Envelope-01: Technical Offer"; financial into "Envelope-02: Financial Offer" marked "Do not open before the technical offer evaluation and approval"; put both in one outer envelope.
  • Deliver by hand, post or courier to the single TDS address before the deadline. Late tenders are returned unopened.
  • Modify, substitute (with a new security) or withdraw only before the deadline, by marked envelopes.

If the tender runs on e-GP, upload both parts in the system instead; the security rules are the same.

08How You Are Evaluated

  1. Technical envelopes open within an hour of the deadline; you may attend.
  2. Missing forms, authorization or security means rejection. Material deviations cannot be fixed later.
  3. Reply to clarifications within the time given (at least 3 working days), without changing substance.
  4. After HOPE approves, you get at least 7 days' notice of the public financial opening.
  5. Arithmetic is corrected (unit price prevails, words over figures). Refusing the correction rejects your tender and forfeits your security.
  6. Ceiling check (10% above estimate), economic factors (late delivery, mandatory spares), then the significantly low-priced tender check.
  7. No negotiation. The lowest evaluated tender is post-qualified; the TEC may visit your premises.

Example: arithmetic correction You quote 10 units at Tk. 24,00,000 each but write the line total as Tk. 2,50,00,000. The TEC corrects it to Tk. 2,40,00,000 (unit price prevails). Accept, or lose the tender and the security.

09Award and Signing

  1. NOA within 3 working days of approval; quantities may be adjusted within the TDS percentage at your unit prices.
  2. Performance security of 10% (PG8-11, draft or pay order) within 7/10/14 working days by estimate size.
  3. Sign within 14/21/28 days; your beneficial ownership is published.
  4. If you take an advance, give a bank guarantee (PG8-12) for the same amount.

Example On a Tk. 7.40 crore award from a Tk. 8 crore estimate, give a Tk. 74 lakh security within 10 working days and sign within 21 days.

Unsuccessful? Ask for a debriefing; complain and appeal under Sections 29–30 of the PPA 2006 and Rules 72–77 of PPR 2025.

10Delivery, Acceptance and Warranty

  • Pack and mark goods as the PCC requires, with a packing list; send shipping documents at least a week before arrival.
  • Carry out the PCC tests at your cost; failed goods are replaced and retested free.
  • The TEAC starts inspection within 24 hours of delivery; the Acceptance Certificate comes within 14 working days, or partially if some items are rejected.
  • Warranty: goods new, current model and defect-free; at least 3 months for supplies and 1 year for equipment from acceptance. Fix defects within the PCC days or the PE uses your retention.

11Getting Paid and Avoiding Penalties

  • Typical terms: up to 10% advance within 30 days of signing against a bank guarantee; the balance on delivery and acceptance, paid within the PCC days, with interest if late.
  • 10% retention is held until the warranty expires.
  • Ask for an extension in writing before the delivery date; the PE decides within 21 days.
  • Late delivery costs 0.03–0.05% per day of the late goods' value, capped at up to 10%; reaching the cap allows termination.
  • A tax-rate change adjusts the price so your net amount is unchanged.

Example: cash flow on a Tk. 7.40 crore contract Advance Tk. 74 lakh against a guarantee; on acceptance the remaining Tk. 6.66 crore less retention; the retention comes back after the 1-year warranty. A 15-day delay on Tk. 1.5 crore of goods at 0.05% costs Tk. 1,12,500.

12Changes, Termination and Disputes

  • Change orders: packing, delivery place or related services may change with a fair price and time adjustment; do not act on a change until it is approved.
  • Additional orders: the PE may reorder within the warranty period, up to 10% of the original price, at your contract unit prices.
  • Notice to Correct: reply within 5 days with your remedy plan.
  • Termination for default: you get a Notice of Default (21 days to explain) and a show-cause notice (7 days). If terminated, you pay the PE's extra cost (15–25% of the revised estimate of undelivered goods) and may be debarred for up to 2 years.
  • Disputes: Adjudicator within 14 days (decision in 28; you pay fees, the PE reimburses half), then arbitration under the Arbitration Act 2001.

13Submission Checklist

  • Eligible; sole tenderer; one tender per lot; subcontracting within the limit.
  • Experience, supply capacity, liquid asset, litigation evidence complete; bank letter dated within 28 days.

14Common Questions

Can I partner with another firm?

Not as a joint venture. You can name subcontractors for up to 30% of the value, and you remain fully responsible.

I am the local agent, not the manufacturer. Can I tender?

Yes, with a Manufacturer's Authorisation (Form PG8-6) if the TDS requires it; the manufacturer extends its warranty through you.

Can I win by quoting far below the others?

No. Tenders below the weighted average minus one standard deviation are rejected as significantly low-priced.

Mine is the only compliant tender. Am I sure to win?

Only if your evaluated price is within 20% of the official estimate (and not more than 10% above it) and you pass post-qualification.

When do I get my retention back?

After the warranty period ends, if the goods are free of patent and latent defects and all obligations are met.
