e-PW3A Works Two Envelope Tender Participation Guideline
How to build the technical offer and the financial offer for a one stage two envelope works tender on e-GP under BPPA's e-PW3A, alone or in a joint venture, and what you commit to once you win.
Preparing the tender document instead? Read the e-PW3A preparation guideline.
This is a working summary, not the official document. The tender document in e-GP for your package, including its TDS, PCC and addenda, the e-PW3A STD, the Public Procurement Act 2006 and PPR 2025 take priority. Worked examples are illustrations.
01Is This Tender for You?
e-PW3A is BPPA's Standard Tender Document for works of any value bought by the One Stage Two Envelope Tendering Method on e-GP, without pre-qualification. The PE uses it when your method, equipment and team are judged before price.
- Nature
- Works
- Value
- Any value
- Envelopes
- Technical + financial
- Pricing
- Unit rate per BoQ item
- Award
- Lowest evaluated responsive
- Tender security
- Yes, fixed amount
- You upload the technical offer and the priced BoQ together before the deadline.
- e-GP opens the technical offers; your BoQ stays encrypted.
- The TEC evaluates; HOPE or the Authorized Officer approves the technical report.
- Only technically responsive tenderers' financial offers are opened and compared.
- Buy the e-Tender Document through an e-GP member bank by the day before the deadline. Visit the site at your own cost.
- One tender per lot, alone or in a JV; two tenders for one lot gets all of them rejected.
02Eligibility and Conflicts
- Legal capacity, trade or professional enrolment, any TDS 5.13 licence, taxes paid, not insolvent, not suspended or debarred, not restricted by a development partner.
- A government-owned enterprise must show legal and financial autonomy.
- The same rules apply to every JV partner and subcontractor. If you win, disclose beneficial ownership.
You are disqualified for a conflict of interest if you:
- control, are controlled by, or share control or a legal representative with another tenderer;
- receive a subsidy from another tenderer or can influence its tender or the PE's decisions; or
- have a partner who prepared the design or specifications as consultant.
03Check Your Qualification
| Criterion | Evidence (goes in the technical offer) |
|---|---|
| General / specific experience | Registration year; completion certificates from e-GP or the PE (Format F) with a similarity note. |
| Litigation | Letterhead statement; pending cases count as lost. |
| Turnover | Public-sector payment certificates or audited accounts. |
| Liquid asset | Bank statement with 3 months' transactions; credit-line balance; Form e-PW3A-8 issued within 28 days before the deadline; or audited working capital. |
| Tender capacity | Forms 6 and 6A with every ongoing contract and payment certificates. |
| Personnel, equipment | Form e-PW3A-5 CVs; letterhead equipment statement with ownership, hire or lease papers. |
Assessed tender capacity = A × N × 1.25 − B (TDS asks for 70–80% of the estimate)
Example: tender capacity on a Tk. 6 crore, 12-month job Best year Tk. 5 crore, Tk. 2 crore of commitments due within the year: 5 × 1 × 1.25 − 2 = Tk. 4.25 crore. At 70% the TDS needs Tk. 4.2 crore, so you pass narrowly; at 80% (Tk. 4.8 crore) you would fail.
04Joint Ventures and Subcontractors
- JV agreement (Format e-PW3A-B, Tk. 300 stamp) or notarised Letter of Intent, plus Form 3 for each partner; respect TDS 17.2's maximum partners.
- Typical split: financial criteria 100% combined, lead 40%, others 25%; lead holds at least one specific-experience contract and the highest business share; others at least 25%.
- Subcontract no more than 30% by value, named in Form e-PW3A-4; later subcontractors need HOPE's written approval.
05The Technical Offer
- e-Tender Submission Letter (Form e-PW3A-1), unaltered, and Forms 2 to 6/6A as applicable.
- Tender security.
- Trade licence, TIN, return acknowledgement for the TDS assessment year, VAT/BIN.
- Technical proposal and ES risk management plan; origin and conformity evidence for materials and equipment.
- Qualification evidence, bank-reference authority, audited statements for the TDS years, autonomy evidence if government-owned, and TDS 23.2(k) extras.
Missing signed forms or a valid tender security means rejection at the preliminary check. Do not put any price, rate or discount in the technical offer.
06Technical Proposal and ES Plan
In e-PW3A the technical proposal decides whether your price is ever seen, so treat it as the heart of the tender.
- Show work methods, equipment, team, a realistic schedule within the completion time, the risks you foresee and how you will manage them, plus anything in TDS 30.1.
- Match every specification and ES requirement point by point; a material deviation, reservation or omission makes you non-responsive and cannot be fixed later.
- Include the ES-MSIP: OHS, community safety, pollution, waste, traffic, grievance mechanism, code of conduct.
07Tender Security and Validity
- e-GP registered bank prepares the security for the TDS 34.1 amount (bank draft, pay order or guarantee on Form e-PW3A-7), valid 28 days beyond tender validity.
- Two-stage evaluation takes longer: expect validity extensions (at most twice). Refusing one costs nothing but takes you out.
- Returned after the evaluation report is approved; the 1st–3rd lowest wait until the winner signs.
- Forfeited if, as winner, you fail to furnish the performance security or sign, or for corrupt, fraudulent, collusive, coercive or obstructive practice.
08The Financial Offer
- Priced BoQ for each lot: a unit rate for every item in figures and words. Unpriced items are never paid.
- Any discount only as a percentage in the e-GP Unconditional Discount Form, applied equally to all items.
- Rates include profit, overhead, VAT, all taxes and duties in force 28 days before the deadline, and banking and insurance costs. Quote in Taka.
- Price consistently with your technical proposal: the method and equipment you promised must be costed.
- Avoid front-loading (risk of up to 20% retention) and very low prices (the SLT test can reject you).
Example: how the SLT test can reject a low bid Estimate Tk. 20 crore, XNPPI Tk. 19 crore, technically responsive tenders of Tk. 17, 18 and 19 crore: the lower limit is about Tk. 17.62 crore, so Tk. 17 crore is rejected.
09Submit Through e-GP
- Both offers in a single submission before the deadline; e-GP sends an acknowledgement.
- Check files are virus-free and readable; upload large files early. Modify, substitute or withdraw only before the deadline.
10How You Are Evaluated
- Preliminary: forms signed and valid tender security.
- Technical: eligibility, conformity, technical proposal, ES plan, qualification. Answer clarifications (at least 3 working days) without changing the tender.
- Approval: HOPE or the Authorized Officer approves the technical report.
- Financial: your BoQ is opened only if you passed; price plus dayworks less discount, then the SLT test (or within 20% of the estimate if you are the only one).
- Post-qualification of the lowest evaluated tenderer.
- The TEC may ask for unit-rate breakdowns but cannot let you change your price.
- Ties go to better past performance, never a lottery. You may request a debriefing and complain under PPA sections 29–30 and PPR Rules 72–77.
11Award, Security and Signing
- The NOA (Form e-PW3A-9) arrives with the draft contract and forms a binding contract.
- Furnish the 5% performance security within 7, 10 or 14 working days (estimate up to Tk. 5 cr, Tk. 5–25 cr, above Tk. 25 cr), valid to 28 days beyond intended completion.
- Sign within 14, 21 or 28 days on the same bands; all JV partners sign.
Example: a Tk. 4 crore contract Tk. 20 lakh performance security within 7 working days, sign within 14 days, then 5% retention on every bill, total capped at Tk. 40 lakh (10%).
12Running the Contract
- Insurance in joint names before the Start Date; any advance against an equal guarantee (Form e-PW3A-12), used only for equipment, plant, materials and mobilisation.
- Programme within the PCC days (usually 15), ES plan within 15 days of commencement, monthly progress reports.
- Deliver the method, team and equipment you proposed; key personnel can be replaced only by equal or better.
- Monthly bills paid within 28 days; price adjustment from month 13 if the PCC provides it.
- Variation notice by the 7th working day; claims notified within 28 days, particulars within 42.
13Delays, Termination and Disputes
- Extension notice within 14 days; PM decides within 21 days of full information.
- LD 0.03–0.05% per day up to ≤ 10%; reaching the cap is a fundamental breach. Bonus for early completion if in the PCC.
- Default termination: Notice to Correct (5 days), Notice of Default (21 days), final notice; 15–25% of the revised estimate of unfinished works; debarment up to 2 years.
- Disputes: Adjudicator within 14 days of the PM's decision (fees shared half-half via reimbursement), then arbitration.
Example: the cost of 20 days' delay On Tk. 4 crore at 0.05% per day, 20 days late costs Tk. 4 lakh; the 10% cap (Tk. 40 lakh) is reached after 200 days.

15Common Questions
Do I submit the two envelopes at different times?
No. Both go in one e-GP submission before the deadline. Only the opening is staged.
If my technical offer fails, will anyone see my price?
No. Financial offers are decrypted only for tenderers found technically responsive after the technical report is approved.
Can I fix a missing document after opening?
Only non-material documentary gaps, and only if your tender is otherwise responsive. Missing forms or tender security cannot be fixed.
Will the TEC correct an arithmetic error in my BoQ?
Do not rely on it. ITT 53.1 says e-GP has no arithmetic correction, and price changes are not permitted. Check your BoQ before submitting.
