e-PW3D DP-Funded Works Tender Participation Guideline
How to tender for works financed by a development partner under BPPA's e-PW3D on e-GP, alone or in a joint venture: the extra DP and environmental and social documents, how your price is checked, and what you commit to once you win.
Preparing the tender document instead? Read the e-PW3D preparation guideline.
This is a working summary, not the official document. The tender document in e-GP, including its TDS, PCC, Section 11 DP documents and addenda, the e-PW3D STD, the Public Procurement Act 2006 and PPR 2025 take priority. Worked examples are illustrations.
01Is This Tender for You?
e-PW3D is used for works of any value financed by a development partner, through open tendering on e-GP without pre-qualification. The PE names the DP in the TDS; the DP's anticorruption guidelines are in Section 11.
- Nature
- Works
- Funding
- Development partner
- Value
- Any value
- Pricing
- Unit rate per BoQ item, in BDT
- Award
- Lowest evaluated responsive
- Envelopes
- One submission, opened together
- Buy the e-Tender Document through an e-GP member bank by the day before the deadline. Visit the site at your own cost.
- One tender per lot, alone or in a JV; two tenders for one lot gets all of them rejected.
02Eligibility and DP Sanctions
- Legal capacity, trade enrolment, any TDS licence, taxes paid, not insolvent, not suspended or debarred.
- Not under restriction by any development partner operating in Bangladesh.
- No conflict of interest with other tenderers or with the design consultant.
If corrupt, fraudulent, collusive, coercive or obstructive practice is found, the PE and/or DP can:
- exclude you from this tender and reject any award recommendation;
- debar you from public procurement for a period; and
- sanction you under the DP's procedures, including public ineligibility for DP-financed contracts, indefinitely or for a stated time.
03Check Your Qualification
| Criterion | Evidence |
|---|---|
| General / specific experience | Registration year; completion certificates (e-GP or Format F). |
| Litigation | Letterhead statement; pending cases count as lost. |
| Turnover | Public-sector payment certificates or audited accounts. |
| Liquid asset | Bank statement, credit line balance, Form e-PW3D-8 (issued within 28 days before the deadline) or audited working capital. |
| Tender capacity | Forms 6/6A with every ongoing contract; A × N × 1.25 − B against 70–80% of the estimate. |
Example: tender capacity on a Tk. 8 crore, 18-month job Best year Tk. 6 crore, Tk. 3.5 crore of commitments due in the next 1.5 years: 6 × 1.5 × 1.25 − 3.5 = Tk. 7.75 crore, which clears both 70% (Tk. 5.6 crore) and 80% (Tk. 6.4 crore).
04Your Team, Including ES Staff
Expect the TDS to ask for CVs (Form e-PW3D-5) for a Project Manager (10 years, 5 similar), Project Engineer, QA/QC Engineer, surveyor, site engineers and lab technician, and, depending on the works, an Environmental Officer, a Social Development Officer and an OHS Officer. Check the exact table in your TDS and line up named people early.
05Joint Ventures and Subcontractors
- JV agreement (Format e-PW3D-B, Tk. 300 stamp) or notarised Letter of Intent plus Form 3 per partner; financial criteria lead 40%, others 25%, combined 100%.
- Subcontract at most 30%, named in Form 4; your subcontractors must follow the ES requirements and the DP's safeguard policies.
06What to Submit
- e-Tender Submission Letter (Form 1) and Forms 2–6/6A as applicable.
- Form 9: letter accepting the DP's anticorruption guidelines and sanctions framework.
- Form 14: Code of Conduct for Contractor's Personnel, initialled.
- Priced BoQ, including the ES safeguard works schedule; tender security.
- Trade licence, TIN, return acknowledgement, VAT/BIN; technical proposal; ES risk management plan; qualification evidence.
Missing signed forms, the priced BoQ or a valid tender security means rejection at the preliminary check.
07ES Plan and Code of Conduct
- The ES plan (ES-MSIP) covers occupational and community health and safety, pollution and dust, waste, traffic, emergencies, a grievance mechanism for workers, and monthly reporting.
- The Code of Conduct's minimum content cannot be weakened. It bans sexual harassment, exploitation and abuse, and sexual activity with anyone under 18; requires PPE, safe working and training; and protects people who report.
- You may add contract-specific measures, which strengthens your technical offer.
08Pricing the BoQ
- Enter a unit rate in figures for every item; e-GP fills the words. Unpriced items are never paid.
- Price the ES safeguard items realistically: they are paid work, and skimping makes later compliance withholdings likely.
- Any discount is one percentage in the e-GP discount form, applied equally to every item in the package.
- Rates include all taxes and duties in force 28 days before the deadline. There is no arithmetic correction in e-GP.
- Keep a rate build-up ready: a very low price will be questioned.
Example: answering an abnormally low tender query You quote Tk. 7.5 crore against a Tk. 10 crore estimate. The PE asks for price analyses. Show material quotes, plant you already own, labour productivity and how your programme fits the price. If you cannot, the tender is rejected.
09Tender Security and Submission
- Tender security from an e-GP registered bank for the TDS amount, valid 28 days beyond validity; forfeited if, as winner, you fail to give performance security or sign, or for prohibited practice.
- Submit early in e-GP; virus-free, readable files. Change or withdraw only before the deadline.
10How You Are Evaluated
- Preliminary check: signed forms, priced BoQ, tender security.
- Technical: eligibility, conformity, technical proposal, ES plan, qualification.
- Financial: price plus dayworks, less discount, excluding contingencies and price adjustment.
- Abnormally low tender review if your price looks too low.
- Post-qualification of the lowest evaluated tenderer.
- Answer clarifications within the time given (at least 3 working days) without changing your tender.
- Ties go to past performance, never a lottery. You can request a debriefing and complain under PPA sections 29–30.
11Award, Security and Signing
- NOA (Form 10) with the draft contract; it becomes binding once you give the security and sign.
- 5% performance security within 7, 10 or 14 working days (estimate up to Tk. 5 cr, Tk. 5–25 cr, above Tk. 25 cr).
- Sign within 14, 21 or 28 days; all JV partners sign; Form 16 (DP letter) becomes part of the contract.
Example: a Tk. 12 crore contract Tk. 60 lakh performance security within 10 working days, sign within 21 days, then 5% retention on each bill, total security capped at Tk. 1.2 crore.
12Running the Contract
- Get the ES risk management plans approved: they are a condition for commencement.
- Insurance in joint names before the Start Date; advance (if offered) against an equal guarantee.
- Run a grievance mechanism for workers, protect chance finds and keep subcontractors ES-compliant.
- ES failures lead to withholding (often 0.1–0.2% per event, capped at ≤ 2%), forfeited if never fixed.
- Monthly bills paid within 28 days; variation notice by the 7th working day; claims notified within 28 days.
13Delays, Termination and Disputes
- LD 0.03–0.05% per day on the value of uncompleted works, capped at ≤ 10%; reaching the cap is a fundamental breach.
- Default termination via Notice to Correct and Notice of Default (21 days); 15–25% of unfinished work charged; debarment up to 2 years plus possible DP sanctions.
- If force majeure frustrates the contract, you are paid for work done and committed.
- Disputes: Adjudicator within 14 days of the PM's decision, then arbitration.
14Submission Checklist
- Not restricted by any DP; Section 11 guidelines read.
- Form 9 signed; Form 14 Code of Conduct initialled.
- Qualification tested against every TDS figure; key and ES staff named with CVs.
- Every BoQ item priced, including ES safeguard works; discount as a percentage only.
- ES risk management plan and technical proposal attached.
- Rate build-up ready to justify a low price.
- Tender security valid 28 days beyond validity; submitted early.
Bidorix can review your ES plan, Code of Conduct and qualification evidence before you submit.
15Common Questions
Will a low price be rejected automatically?
No. There is no formula cut-off in e-PW3D. You are asked to justify the price with detailed analyses; rejection follows only if you cannot show you can perform.
Can I edit the Code of Conduct?
You can add requirements but not weaken the minimum content set by the PE.
Do I need ES officers on my team?
If the TDS lists them, yes. The STD's indicative table includes Environmental, Social Development and OHS officers, scaled to the works.
What if my rates have an arithmetic mistake?
e-GP makes no arithmetic correction and price changes are not allowed, so check the BoQ before submitting.
